Netherlands Commission for Environmental Assessment
1. Country and regional programmes
Country and regional programmes on environmental assessment form the core of our work. These programmes are implemented in Dutch focus countries and regions for development cooperation. The activities under these programmes are structured as follows: 1) Activities to strengthen key functions of the national ESIA/SEA system, being Regulatory Framework; Awareness, Commitment and Funding; Higher Education; EA Helpdesk; System Monitoring; and Professional Exchange; 2) Activities to support the development of organisational capacity in the national ESIA/SEA system; 3) Activities to support individual ESIA/SEA processes within these countries and regions, through independent advice or coaching. Moreover, the programme contains budgets for reconnaissance and M&E of its activities.

1.01 Country and regional programmes: regulatory framework
An important function within an environmental assessment (EA, either ESIA or SEA) system is the ESIA and SEA regulatory framework. An EA regulatory framework is important both for the EA process and for the decision-making process that is supported by the assessment. The regulatory framework consists of legal texts (law, decrees) and of relevant guidance that is needed to apply these legal texts. Support from the NCEA may include: • Comment on draft legal texts, guidance etc; • Facilitation of workshops for drafting of legal texts and guidance; • EA mapping and gap analyses.

1.02 Country and regional programmes: awareness, commitment & funding
Within an environmental assessment (EA) system a systematic effort needs to take place to raise awareness on EA, to raise commitment for the instrument of EA, and to ensure that sufficient funding is available for EA. Support from the NCEA may include: • Prepare information for discussion and debate on related subjects such as how to finance EA; • Join partner organisations in meetings with high level decision makers aiming at getting EA on their agenda; • Make presentations at EA related events (for example seminars).

1.03 Country and regional programmes: higher education
For a country to ensure the necessary professional expertise on environmental assessment (EA), it needs to make available education for professional development on ESIA and SEA. This includes EA related education at the tertiary level, teaching in academic or knowledge institutions, and professional training. The NCEA can be involved in several ways: • In the development of curricula at teaching institutions. This can also be done at the initiative of the national EA association; • Provide technical inputs to education and training programmes that are part of these curricula; • Provide technical inputs to training programmes and sessions that are organised for EA professionals; • Provide training of trainers (ToT) to ensure sufficient training capacity for the above mentioned programmes. The NCEA can facilitate complete ToT trajectories, or can provide technical input where needed.

1.04 Country and regional programmes: system monitoring
Each country that decides to have an ESIA and SEA system in place should also monitor whether these instruments are properly applied, and thus to keep track of how the national EA system performs. For this purpose of monitoring, a filing system or database is required that allows tracking of specific ESIA/SEA dossiers, and the gathering of performance related information over years and for each sector. Such a database may also be linked to the helpdesk function in cases where the database is (partly) publicly accessible. Support from the NCEA may include: • Advice on the development of an ESIA/SEA database. This primarily focuses on contents. For example, what type of information and documentation needs to be available and to whom? • Organisational advice on structure and set up the database and on whether certain elements could be made more widely available (publicly or for identified groups), for which external expertise may be required. • Assistance on the analysis of monitoring results, which involves drawing conclusions on the performance of the system and subsequent identification of needs for further strengthening.

The NCEA defines this function of the EA system as the existence and functioning of a platform for professional exchange. Through this platform, EA professionals may find each other to debate and exchange on ESIA and SEA, theory and practice. Often, in NCEA’s experience, this is initiated by a professional EA association in which these practitioners convene. Support from the NCEA may consist of: • Technical expertise in the form of comments on documents of the EA association; • Coaching of the (non) formal EA association on organisatinal and administrative issues; • Technical input to (training)sessions organised by the EA association.

1.06 Country and regional programmes: organisational and individual capacity
It is essential for the effectiveness of an EA system that organisations with a responsibility in this system have the capacity to perform their tasks. This relates to both governance and technical capacity. It applies both to governmental organisations with formal roles and to non-governmental organisations with more informal roles, such as NGOs and universities. In the NCEA systems approach, the roles of organisations are related to system functions. We maintain a broad definition of organisation. For example, we consider a network of professionals as an organisation that contributes to EA system functions. Traditionally, some of the activities of the NCEA are targeted towards individuals, often comprising of a small selection of individuals from different organisations, such as a team responsible for ESIA within an environmental agency. These activities are geared towards supporting individual professional development to enable them to perform their specific tasks within the organisation or network. This usually involves individual training and/or coaching, often and preferably as components of organisational capacity development interventions. The NCEA’s work on capacity, both on an organisational and individual level, differs greatly in focus and in number or size of training and advisory related activities. The focus of these training activities could be on the overall EA procedure, on specific steps in the EA process such as scoping and review, on EA and compliance, on process related topics such as public participation, communication or negotiations skills, to name a few. The focus and size of activities depend on the country’s needs, influenced by the stage of development and effectiveness of the EA system, the ambition level, the size of the country, the level of decentralisation.

1.07 Country and regional programmes: independent advice
Our advisory trajectory starts with a request for an advice by an eligible authority. This will usually be the local authority responsible for EA approval, but the request can also come from Dutch organisations such as DGIS, embassies, or the RVO. The advice is intended to contribute to the following objectives: • Increase the influence of the requesting authority in the decision-making arena. As a result, they can demand higher performance in EA, which means that the quality of the environmental assessment process and the final ESIA report are improved, resulting in a better quality of the project or plan that is based on the assessment. • Capacity development of one or more organisations involved in environmental assessment. This results in better EA reports, better informed decision-making, better decisions and better projects or plans, as well as implementation that is in compliance with the environmental license conditions or the adopted plan. • Help ensure that project and plans meet national or international quality standards, because they are based on good quality environmental assessment.

1.08 Country and regional programmes: SEA coaching
When the NCEA coaches an environmental assessment, this means that the NCEA supports, in a step by step process, one or more local parties that have an important role in this assessment. In practice, coaching is only requested for SEA processes and not for ESIA processes. The objective of coaching is twofold: 1. To assist the organisation that the NCEA is coaching in performing their role in the ongoing environmental assessment process; 2. To support a learning process, so the organisations involved can build capacity to execute their tasks without external support in future for SEA or ESIA processes.

Before the NCEA starts working with a partner in a country, there is a phase of reconnaissance: a request is made by the partner, and the NCEA takes time to assess the request in detail, to discuss what further needs to be done, to hold meetings with other actors in the ESIA and/or SEA system, with the Netherlands Embassy and other donors active in related fields. Sometimes, activities cannot start straight away due to circumstances in the country. The reconnaissance phase may therefore vary in duration.

1.10 Country and regional programmes: planning, monitoring and evaluation
The level of M&E activity in a country will be commensurate with the level of co-operation in that country. The more resources are allocated to a cooperation, and the more activities take place, the more effort will go into tracking the results of those activities. When the NCEA advises on a concrete ESIA or SEA case, the M&E is structured according to three monitoring moments with a set of questions: • M1 – directly after delivery of advice, to check that it is well received and has been shared with relevant partners; • M2 – after ESIA or SEA revision has taken place, to check whether advice has improved ESIA or SEA; • M3 – after decision-making on the project or plan has taken place, to check whether the project or plan has improved.

2. Private sector development
In its current policy on development cooperation, the Dutch government emphasises the need to focus not only on aid but also, and increasingly, on trade. As a result, more international cooperation resources are allocated to facilities that finance public and private sector or joint public –private partnership projects in developing countries and emerging markets. These Private Sector Development (PSD) instruments include: • Two facilities for development of public infrastructure: Develop2Build (D2B) and DRIVE. The third infrastructure facility, ORIO, has been closed for new applications, but approval and monitoring processes for projects that have already been accepted are still ongoing; • The Sustainable Water Fund (FDW); • The Dutch Good Growth Fund (DGGF), which provide financing for Dutch small and medium enterprises. All of these facilities are managed and implemented by the Netherlands Enterprise Agency (RVO), and are open to investments in over 60 countries. For many projects, if not most, an ESIA will be undertaken. Often ESIA is obligatory according to the legislation of the country where the project will be implemented. But ESIA is also central to the IFC Performance Standards, which are an important benchmark for the above mentioned facilities. The NCEA’s strategy is to provide fit-for-purpose and independent advice for each of the RVO PSD facilities where ESIA plays a role in risk management. In relation to the above, the activities under the PSD programme consist of: • Screening of project proposals against the national ESIA regulations and the IFC performance standards; • Independent advice on specific ESIAs for projects under consideration for financing. This includes review of Terms of Reference and ESIA reports, but also advice on ESIA implementation in relation to project development; and on monitoring and implementation of an ESIA/environmental and social management plan; • Helpdesk and workshops for RVO staff and project proponents.

2.1 Private sector development: screening
Since 2009, the RVO has been asking the NCEA to screen project proposals that have been submitted for financing under the PSD facilities. The NCEA's screening focuses on whether or not an ESIA is required according to the receiving country’s legislation. Where necessary, we also check which IFC performance standards are triggered by the project. This way the RVO is better able to anticipate the requirements that need to be met, can communicate its expectations to project proponents, and avoid unexpected procedural delays further down the line. For the coming years, we expect a continued demand from the RVO to provide this type of advice. For many of the facilities, applications can be submitted anytime, and we screen the proposals as they come in. For the FDW and FDOV facilities, proposals are submitted in batches, and we screen a larger number of project in one go. Going by past experience, the NCEA assumes 2 rounds of calls each for FDW and FDOV in between 2017 and 2022.

2.2 Private sector development: independent advice
The NCEA provides advice on the scope, process and content of ESIAs for projects submitted to the PSD facilities. The NCEA's advice ensures the RVO that all relevant risks are in clear view before financing is allocated. Our advice has become increasingly integrated into the working processes of the RVO. The NCEA's ESIA advice has expanded to include relevant IFC performance standards, and in some cases, the implementation phase of projects. For example, the NCEA can check if an ESIA tackles resettlement in a way that meets IFC PS 5, or look at how ESIA conclusions have been addressed in the environmental and social management of a project.

2.4 Private sector development: capacity development and workshops RVO staff & investors
Complementary to our advice on specific ESIAs for project under the PSD facilities, the NCEA also provides workshops to both RVO staff and project proponents on the how and why of ESIA. The workshops serve to introduce the concept of ESIA to those for whom it is new (including new staff at the RVO - there is regular turn-over), to present good practice in relevant areas (water, public infrastructure), but also to exchange views on how ESIA relates to the facilities themselves. The workshops improve both the applicability and the uptake of the NCEA's ESIA advice. We generally hold workshops twice a year. Each one is tailormade for the target-group and contains examples and cases for the funds in question. In addition, the NCEA functions as a helpdesk for RVO and project proponents. They can approach us for clarification of ESIA procedures, sectoral ESIA guidelines and other related information.

3. Sustainable finance
The Netherlands invests substantial resources to achieve development goals. A good part of these investments is made through Dutch funding and credit institutions such as FMO and Atradius, through multilateral institutions like the World Bank and IFC, and through thematic funds such as the Green Climate Fund. For all of these institutions and funds, ESIA is mandatory. It is a key component of the 'safeguard systems' for politically sensitive and risky projects. ESIA is also an obligation under the OECD 'common approaches' for export credits. Through ESIA, banks and credit institutions aim to make sure that investment decisions are sufficiently substantiated, are compared with strategic alternatives, and are the result of a transparent and inclusive process. This is essential, both in terms of risk management and to avoid reputational damage. ESIA can only play a contributing role if the prepared ESIA reports are of good quality and are seen as a credible basis for discussions by all stakeholders. The NCEA can contribute to this. As a recognised independent and neutral party, the NCEA can review the quality of the ESIA reports and process. ESIA is not only embedded in (international) safeguard systems, but also established in the national legislation of countries. Targeted capacity development by the NCEA in countries important for the Netherlands can help to prevent bottlenecks in national legislation.

4. Knowledge and learning
The knowledge and learning strategy is based on the assumption that learning, knowledge sharing and communication are closely interlinked. To be successful, our strategy includes activities on all three of these elements: • Organisational learning is key to our work. We want to learn from our country activities and our systems approach. We want to find out what works and what can be changed in order to improve our practice in the countries. Central to our M&E process is listening to our partners and clients including EA professionals, governments, and NGOs. • To improve our work and that of our partners in developing countries, knowledge sharing is crucial. For example, knowledge on the effectiveness of EA, on the added value of the process (such as a more sustainable project/programme or more effective stakeholder engagement), and on the effectiveness of a systems approach. This knowledge is based on our own experience, but comes from other organisations as well. We produce and update knowledge products such as case studies, gap analysis tools and our country profiles. • Our communication is concerned with informing the general public, our partners, and all other stakeholders on who we are and what we do. Specifically, we inform EA colleagues, partners and clients how our products and services can be used to facilitate their work. We produce knowledge products with inspiring stories on environmental assessment and its results.

Knowledge products include: • Cases on EA in specific sectors such as hydropower, climate change, extractive industry or on the introduction of SEA; • Tools and building blocks on scoping and review; • Presentations at international conferences and seminars. These products are used by NCEA staff in their programmes, in presentations and training workshops. They also provide information for DGIS / EKN staff on results of NCEA work and added value of environmental assessment. Also, fellow EA practitioners worldwide use them, both for capacity development and as input for research. Some specific cases and publications are targeted at multi-lateral platforms such as the IPCCC to stimulate debate on the use and added value of EA instruments in obtaining their objectives. We also provide the NCEA helpdesk. This helpdesk is coordinated by the knowledge and communication staff and largely carried out by the technical secretaries. It aims to address questions from various target groups, varying from queries on specific sectors, such as EA for hydropower, to more requests for procedural information on, for example, quality assurance in the EA process.

5.2 Reservation: Shared Resources, Joint Solutions
In 2015, IUCN-NL and WNF were granted funding from DGIS for the strategic partnership programme Shared Resources, Joint Solutions (SRJS, 2016 – 2020). In several regions and individual countries, ESIA and SEA are important elements in the SRJS programme. The NCEA has been asked to provide technical assistance. In some cases, the NCEA can integrate assistance in its existing country programmes. Budget needs in partner countries that could not yet be foreseen when we were drafting our 5-year programme, can be included in the 'reservation' section.

3.6 Sustainable finance: higher education
For a country to ensure the necessary professional expertise on environmental assessment (EA), it needs to make available education for professional development on ESIA and SEA. This includes EA related education at the tertiary level, teaching in academic or knowledge institutions, and professional training. The NCEA can be involved in several ways: • In the development of curricula at teaching institutions. This can also be done at the initiative of the national EA association; • Provide technical inputs to education and training programmes that are part of these curricula; • Provide technical inputs to training programmes and sessions that are organised for EA professionals; • Provide training of trainers (ToT) to ensure sufficient training capacity for the above mentioned programmes. The NCEA can facilitate complete ToT trajectories, or can provide technical input where needed.
