PROG 2017-2021_Travail décent
La création d'emplois décents, les droits au travail, la protection sociale et le dialogue social, un programme commun mis en oeuvre par FOS, IFSI/ISVI, SolSoc.
L’ambition de FOS, de l’IFSI et de SolSoc est le renforcement de mouvements engagés dans la promotion du Travail Décent et de leur convergence pour répondre aux défis du XXIe siècle : construire des alternatives solidaires, politiques, sociales et économiques, viables et durables à la mondialisation du modèle prédateur de la compétition économique et retrouver un rapport de force favorable pour qu’elles soient adoptées et mises en oeuvre. Les interventions des 3 OSC dans les pays du Sud découlent toutes des cibles et sous-cibles stratégiques décrites dans le CSC Travail Décent : la création d’emploisdécents, les droits au travail, la protection sociale et le dialogue social. Exception faite de l’un des deux objectifs spécifiques Palestine articulés au CSC Palestine. Les activités prévues pour le volet «Belgique» sont entièrement liées aux cibles stratégiques du CSC «Belgique» tout en garantissant la cohérence avec le CSC Travail Décent.

Vu la globalisation, l’internationalisation de la prise de décision politique, la montée en puissance des multinationales, la transformation des modes de production et de l’organisation du travail ainsi que l’intensification des phénomènes migratoires, les organisations représentatives des travailleurs doivent se structurer et s’organiser pour relever les défis posés par ce contexte singulier. Pour répondre à cette ambition, cette intervention continentale africaine portée conjointement par l’IFSI et ses partenaires du Sud s’organise en deux axes principaux et complémentaires. Le premier vise à renforcer le syndicalisme de réseaux aux niveaux continental africain et international afin que les organisations syndicales africaines soient mieux à même de défendre les droits des travailleurs et des travailleuses aux différents niveaux. A travers la mise en réseaux, ce premier axe permettra d’une part, de renforcer une représentativité syndicale à un niveau continental et international en mettant en relation syndicats et travailleurs tant au niveau sous-régional, continental qu’international. D’autre part, cette intervention renforcera l’unité d’action syndicale africaine qui favorisera la construction de contre-pouvoirs forts promouvant et défendant des sociétés démocratiques respectueuses des droits syndicaux et humains. Le deuxième axe fort de cette intervention vise à relever les défis soulevés par l’intensification des flux migratoires au niveau sous-régional de l’Afrique de l’Ouest. Il s’agit de renforcer un travail de conscientisation sur l’articulation entre les droits des travailleurs migrants et les droits humains afin de promouvoir et d’adopter des politiques et des stratégies syndicales communes pour faire respecter ces droits par la pratique du dialogue social.
Les organisations syndicales d’Afrique de l’Ouest comprennent mieux les articulations entre les droits des travailleurs migrants et les droits humains et adoptent des nouvelles politiques et stratégies communes en vue de renforcer le respect de ces droits par le dialogue social.

Les organisations syndicales d’Afrique de l’Ouest comprennent mieux les articulations entre les droits des travailleurs migrants et les droits humains et adoptent des nouvelles politiques et stratégies communes en vue de renforcer le respect de ces droits par le dialogue social.
Accords collectifs de travail
Aucun des pays ciblés n’a d’accord collectif de travail qui protège les droits des travailleurs migrants. Par contre certains pays de la CEDEAO en possèdent (ex : le Nigeria). Un des enjeux centraux qui concerne la garantie des droits des travailleurs migrants concerne la portabilité des droits en protection sociale. À ce jour il est très difficile pour un travailleur de transférer ses droits d’un pays à l’autre.
En 2019, les organisations syndicales partenaires ont négocié 1 convention collective de travail dans 5 pays ciblés qui prennent en compte les droits des travailleurs migrants en tenant compte notamment de la portabilité de ces droits.
In Africa, and for the target countries under the project, migrant workers are not considered as different from nationals. Therefore, where trade unions have made collective agreements, those agreements have not separated workers into migrant and nationals. Nevertheless, the trade unions in the target countries are clear that migrant workers should not be discriminated against. However, an interesting discovery is the situation where trade unions in these countries have actually noticed that most migrant workers, considered as expertrates are treated far better than the local workers. This is the case, very common with in the construction and mining sectors. The unions of participating countries have been involved in integration assistance for migrants. For example, the unions in Benin now allow migrant associations to use their facilities/offices/halls for convening migrants’ association meeting. Trade unions also invite migrant associations to their May Day commemoration events. The unions have also been very active in advocating for Visa on arrival campaign for all bearing African passport. The campaign saw Togo, Senegal and Nigeria now fully operating this policy.
En 2021, les organisations syndicales partenaires ont négocié 1 convention collective de travail dans au moins 7 pays ciblés et 1 au niveau de l’Afrique de l’Ouest (CEDEAO) qui prennent en compte les droits des travailleurs migrants notamment ceux liés à la protection sociale.
For migrant workers, any collective progress is important. Every step that individual countries in Africa take strengthens their rights or improves their working conditions and lives. In that sense are the ratifications of ILO convention important first steps and should be validated. The following countries ratified the prioritised conventions – Morocco (C97); Madagascar (C189); Mauritius (C190); Somalia (C97, 143, 155,181 and 190); Tunisia (C187); Sierra Leone (C97, 143, 155, 181, 187, 189).
Labour standards, ratification, application and enforcement now highly accepted and being pursued within the African Union Labour Migration Governance circle.
Trade unions’ knowledge, skills and capacities on how to be active in the application and enforcement of ratified conventions are on the steady rise.
ATUMNET participated in the development of the African Union Declaration for the promotion of the rights of migrants and members of their families.
The issues of employment and employment contract are contained in the Declaration. The AU Declaration has been adopted.Working relationship among tripartite social partners in Africa on labour migration governance is gaining steady improvement.
Sierra Leone has developed and adopted a model migrant employment contract.
The trade unions in Bénin négotiated the inclusion of migrant workers in the national social security scheme ARCH. This system is stil in a pilote phase but nevertheless is this an important achievement.
Memorandum of Understanding (MoU)

En 2019, les organisations syndicales partenaires ont signé 3 MoU qui balisent les alliances avec d’autres organisations syndicales ou ONG au niveau national, continental ou international sur la défense des droits des travailleurs migrants.
In 2019, ITUC-Africa has moved towards the implementation of already signed MoUs with 5 other regional trade union organisations in Latin American and Asia; and also that of the membership of the Pan African Network in the Defence of Migrants’ Rights (PANiDMR). These implementation can be seen in the collation of African trade unions’ best practices’ contributions to fair recruitment. For PANiDMR, ITUC-Africa was made the lead organisation to prepare and speak on a sub-theme of the 2020 Global Forum on Migration and Development (GFMD) under the United Arab Emirates Chairperson’s regional consultation . At the target countries level, trade unions are collaborating with NGOs on migration engagement though not with signed MoU. Countries where Trade unions – NGOs engagement are visible and growing include Senegal, Togo, Cote d’Ivoire, Guinea, Benin, Burkina Faso, Morocco, Mauritania and Niger.

The UN GCM opened opportunities for trade unions and other CSOs. Their role in managing and governing migration has been recognized and aknowledged. The project aimed to work more closely to NGOs , but unexpectedly the several UN agencies (IOM, ILO, UNHCR, became partners in the regional and national strategies on migration. Much to a lot of observer's surprise, trade unions and other organisations of the CS ATUMNET (ITUC-Africa and its member organisation) participated in and made inputs into the UN GCM African Regional Review processes that took place from March – September 2021. A working arrangement on how to prepare for and follow-up on the International Migration Review Forum for 2022 has been agreed within the AU-LMAC process – a testament to the improving working relationship. The review itself was in New York in May 2022, which is outside the scope of this report. In various countries, national confederations got involved in the national migration networks set up by the IOM country offices.
